The website www.thecompanionship-registry.com (hereinafter the Platform) is managed by Nalem15-MEDIA SRL, company number BE0805-916-382 (hereinafter the Administrator)

This document specifies the Terms of Use to which the User is subject when using the services of the Site. These conditions represent a binding agreement between the User and The Companionship Registry, which operates the Site you are accessing. Use of the Site implies the User’s unconditional and automatic acceptance of the entirety of these terms and conditions of use, as well as a commitment to abide by them. If the User does not wish to subscribe to all or part of the said conditions, he/she is requested not to use the Site.

The Companionship Registry reserves the right to modify or supplement these terms and conditions at any time, without notice or compensation. It is the User’s responsibility to take note of any updates to these terms and conditions each time he/she connects to the Site. These terms and conditions include exclusions of warranties and limitations of liability of which the User declares that he/she is aware. You accept these conditions each time you access the Site or use the services of The Companionship Registry.

The Companionship Registry reserves the right to suspend or terminate the access of Users who fail to comply with these terms and conditions. The Companionship Registry reserves the right to deny access to the Site to any User, at any time, unilaterally, without refund and without prior notice, whether in whole or in part, particularly in the event of a clear violation of these terms by the User.

For the purposes of these terms and conditions, a “user” is any person accessing the site and making use, even in a purely passive manner, of the services offered therein.

In view of its content, the Site is intended exclusively for an adult audience. It follows that the use of this site, in any way whatsoever, is formally forbidden to any person who is not of legal age according to the law applicable in the country in which he or she lives.

Publication of an ad

The user guarantees that any ad that he wishes to publish on the Platform meets the quality criteria that a visitor to the Platform can reasonably expect: the description of the services and the conditions must be correct, clear and unambiguous. The elements of the description of the ad must be submitted in advance to the Administrator via the following e-mail address info@thecompanionship-registry.com, who unilaterally decides whether or not to publish. Any false or misleading ad can be removed at any time by the Manager in accordance with the provisions in the section “Limitation of the publication of ad” below.

The photos intended for publication must have a good resolution (minimum 1920×1080 pixels). In order to maintain the quality of our services, the Administrator has the option in advance not to publish a photo.

The administrator reserves the right to make technical changes to the content, and in particular to the content of the advertisements (for example, in the context of reuse). This may be necessary, among other things, to make the advertisements accessible on various channels, including mobile phones.

Free first shoot offer:

The Free First Shoot is a one-time offer applicable only to the first shoot in your first month of companion membership. This free session includes a photography session of a pre-determined duration by our affiliated photographer.

Subscription conditions:

Monthly subscription fees must be paid on the anniversary date on which your profile goes online.

Refund in the event of early termination:

If you decide to discontinue your presence on the platform before the end of the first three months of paid subscription, the fees corresponding to the photographs from the first photo shoot, as well as the rental fees for the photo shoot location and profile management (with a combined value of €475), will be invoiced and must be refunded in full.

Refund procedure:

Refunds will be made to our designated bank account within 15 days of your departure from The Companionship Registry

Restriction on the publication of advertisements

The pricing of an ad is determined before publication. The user may not change his ad by replacing one type of offer with another. In this case, he must place a new ad at the rate applicable to the chosen offer. Even if the user removes his ad from the platform early, he cannot claim a full or partial refund. The user accepts that once an ad has been placed on the platform and paid for, there is no right of withdrawal or full or partial refund for this ad.

We reserve the unilateral right to deactivate or refuse an advertisement placed on our platform, before the end of the publication period and without compensation, in the following cases:

  • Descriptive text violates these Terms of Use.
  • An ad is wrong, or an ad is illegal.
  • Access ban to the platform

We reserve the right to unilaterally prohibit access to all or part of the platform to any physical or legal person:

who would violate these Terms of Use

who would use the personal data to which he may have access through the platform to offer paid products or services or to send unsolicited messages to the e-mail addresses of other Internet users (“spamming”) for any commercial purpose or on another unauthorized manner;

who would place false advertisements on the platform, advertisements already placed by the same physical or legal person or illegal advertisements;

which would damage the good reputation of the Manager or the platform in a certain way;

that would infringe on the intellectual rights of third parties;

who would use the platform for unlawful purposes. We also reserve the right to prosecute the same persons.

Availability of the platform

Although we are committed to making the Platform available seven days a week and 24 hours a day, we reserve the right to interrupt access to the platform at any time and without prior notice for technical or other reasons. We also reserve the right to terminate our services without being held responsible for these interruptions and the possible consequences thereof for you or for third parties.

The Administrator will, as far as possible, ensure that the platform and the files can be downloaded and are free of bugs, viruses, Trojan horses, spyware and other malicious or unapproved software. However, it cannot be ruled out that these things are still present. The Administrator can under no circumstances be held liable for any damage and/or loss resulting from this for the user. The Administrator strongly advises the user to install firewalls, an antivirus program and other necessary security programs on his device.

Intellectual Rights

The entire content of the Platform, including the texts, graphics, logos, buttons, images, code, database and icons, is the intellectual property of the Administrator and is protected by intellectual property rights, such as copyrights and the rights of the producer of a database.

The design of the platform (plan, choice and arrangement of the sections, organization of the data, …) are protected by the legal policy with regard to copyright. The Administrator prohibits the reuse of the entire content of the platform or of a qualitative or quantitative part thereof. The Belgian law of 31 August 1998 on the legal protection of databases (transposition of European Directive No. 96/9/EC) stipulates that infringement of these rights is subject to penalties ranging up to a fine of €500,000 and, in case of repetition, up to 2 years in prison.

With this document, the Administrator grants the user of the Platform a non-exclusive, non-transferable and revocable license at any time without reason to access, display and download the content on a computer for the sole purpose of consulting this content. The user may also print a copy of the content displayed on the Platform for his personal use only, provided that he does not modify the content of the Platform in any way and that he retains all attributions of authorship and origin of the platform. Reproduction is, therefore, only permitted for personal use and as a personal copy within the meaning of the copyright law.

Certain names, features and logos on the Platform are registered trademarks or trade names owned by the Administrator. Any use of names, brands and logos and/or the unauthorized use of similar signs is prohibited unless expressly and in advance by the licensees.

Any copy, translation, adaptation, modification or any use whatsoever of the whole or of any of the protected elements of the Platform, in any form and by any means, is strictly prohibited without the prior written consent of the Administrator. Any commercial use of the content of the Platform is strictly prohibited.

Unless explicit refusal which need not be justified, the creation of a hyperlink to the start pages of the Platform is permitted. Any hyperlink to a page within the sites is therefore prohibited unless explicit and prior permission from the Administrator.

Under no circumstances can the Administrator be held responsible vis-à-vis visitors to the Platform for complaints or legal actions brought against them by a third party claiming that the use of any element of the content of the platform or any of the products or services offered by the platform would infringe its intellectual property rights.

Conditions of sale and payment

All reservations or orders for services on the Site are firm and final. In accordance with current legislation, the user-consumer is aware that, as all orders are executed immediately, he/she loses his/her right of withdrawal and expressly agrees to this.

The Companionship Registry has taken and continues to take all necessary and useful measures to ensure the security of its users. Nevertheless, users pay online at their own risk and they expressly agree to this each time they make a payment, however small or occasional.

In the event of loss or theft of identification or financial data, the user shall contact the relevant partner, The Companionship Registry assuming no responsibility in this regard.

Miscellaneous provisions, applicable law and case law

The invalidity, voidness or unenforceable nature of all or part of any of the above provisions shall not invalidate all terms of use of this document. The provision in question is deemed not to have been written, and the user accepts that the Administrator will replace this provision with another that will, as far as possible, have the same function.

For any dispute arising from the use of the platform, Belgian law applies, and only the courts of Hasselt, Hasselt department, have jurisdiction.
